By browsing our website, submitting inquiries, booking appointments, or placing orders with Bay Stone Depot, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to our website. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.

Bay Stone Depot specializes in luxury natural stone slabs, porcelain tiles, quartz surfaces, and specialty materials for residential and commercial projects. Please note the following:

• Natural Variation: Natural stone products such as granite, marble, quartzite, onyx, and travertine are products of nature. Each slab is unique and will exhibit variations in color, veining, pattern, texture, and movement. Samples and photographs are representative only and are not guarantees of exact appearance. We strongly recommend visiting our showroom to view full slabs before purchasing.
• Product Availability: All products are subject to availability. Because many of our slabs and tiles are imported from quarries worldwide, specific materials may have limited inventory and may not be restockable once sold.
• Measurements and Sizing: Slab dimensions listed on our website are approximate. Actual slab sizes may vary. Final measurements should be confirmed with our team prior to purchase, especially for fabrication projects.
• Color Accuracy: We make every effort to display product colors and textures as accurately as possible on our website. However, monitor settings, screen calibration, and lighting conditions may cause colors to appear different from the actual material. In-person showroom viewing is always recommended.

All prices listed on our website and in our showroom are in U.S. dollars and are subject to change without prior notice. Quoted prices are valid for 30 days from the date of the quote unless otherwise specified in writing. We accept the following payment methods:

• Cash, check, and major credit cards (Visa, Mastercard, American Express, Discover).
• Wire transfers for large orders.
• A deposit of 50% is required at the time of order placement for custom and special-order materials. The remaining balance is due prior to delivery or pickup.

Applicable sales tax will be added to all orders in accordance with California state and local tax regulations unless a valid resale certificate is provided.

Bay Stone Depot offers delivery services for stone slabs and bulk tile orders within the greater San Jose and Bay Area region. Please be aware of the following:

• Delivery Scheduling: Delivery dates are estimates and not guaranteed. We will make reasonable efforts to meet scheduled delivery windows and will communicate any delays promptly.
• Site Requirements: The delivery location must be accessible for our trucks and equipment. The customer is responsible for ensuring adequate access, clearance, and a suitable area for material unloading. Additional fees may apply for difficult access locations.
• Inspection Upon Delivery: Customers must inspect all materials at the time of delivery. Any visible damage or discrepancies must be noted on the delivery receipt and reported to us within 24 hours. Claims for damage not documented at delivery may not be honored.
• Will-Call Pickup: Customers may arrange to pick up materials from our showroom. Materials must be picked up within 14 days of payment unless alternative storage arrangements have been agreed upon in writing. Storage fees may apply after 14 days.

Due to the custom and specialty nature of natural stone and tile products, our return policy is as follows:

• In-Stock Items: Unused, undamaged in-stock materials may be returned within 7 days of purchase with the original receipt. A restocking fee of 25% will apply. Materials must be returned in their original condition and packaging.
• Custom and Special Orders: Custom-ordered materials, special-order slabs, and fabricated products are non-refundable and cannot be returned. This includes any material that has been cut, polished, or otherwise altered to customer specifications.
• Damaged or Defective Products: If you receive materials that are damaged or defective, please contact us within 48 hours of delivery with photographs of the damage. We will arrange for inspection and, at our discretion, provide a replacement or credit.
• No Returns on Installed Materials: Once materials have been installed, fabricated, or cut, they are no longer eligible for return or exchange.

Bay Stone Depot passes through all manufacturer warranties on products we sell. Warranty terms vary by product and manufacturer. Please note:

• Natural stone products are sold “as is” regarding natural characteristics such as color variation, veining, pitting, and fissures. These are inherent properties of natural stone and are not considered defects.
• Warranty claims must be submitted in writing with photographs and a description of the issue.
• Warranty does not cover damage resulting from improper installation, lack of maintenance, misuse, exposure to harsh chemicals, or normal wear and tear.
• Bay Stone Depot is not responsible for installation. We recommend hiring qualified, licensed professionals for all stone and tile installation work.

To the fullest extent permitted by applicable law, Bay Stone Depot, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website, purchase of our products, or any services provided. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.

Our total aggregate liability for any claims arising from or related to these Terms or your use of our products and services shall not exceed the total amount you paid to Bay Stone Depot for the specific product or service giving rise to the claim.

Bay Stone Depot does not guarantee that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any delays, failures, or interruptions in service beyond our reasonable control.

All content on the baystonedepot.com website — including text, images, photographs, graphics, logos, icons, and design elements — is the property of Bay Stone Depot or its content suppliers and is protected by United States copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without prior written consent.

These Terms and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction and venue of such courts.

You agree to indemnify, defend, and hold harmless Bay Stone Depot, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or in any way connected with your violation of these Terms, your use of our products, or your breach of any applicable laws or regulations.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
